Tropicana Casinos Accused of Violating Wage Laws

Casino operator violated the Fair Labor Standards Act, according to recent lawsuit

A class action lawsuit has been filed against Tropicana Entertainment, a regional casino and entertainment company, and one of its subsidiary casinos doing business as Lumiere Place Casino and Hotels in St. Louis, Missouri for failing to pay its hourly employees properly under federal and state wage laws.  

The complaint filed in the United States District Court for the Eastern District of Missouri alleges that Tropicana violated their employees’ rights by: (1) improperly “rounding” employees’ clock-in and clock-out times; (2) deducting gaming license fees from employees’ wages; (3) failing to inform tipped employees of the required tip credit provisions before paying a sub-federal minimum wage; and (4) miscalculating tipped employees’ overtime rates resulting in underpaying overtime wages. 

The lawsuit seeks to recover unpaid wages for all hourly employees who worked at one of Tropicana’s casinos between March 12, 2016 and the present.  

The case is Traci L. MacMann v. Tropicana Entertainment, Inc., et al., No. 4:19-cv-00404-RWS, in the U.S. District Court, Eastern District of Missouri.  The named plaintiff is a table games dealer and dual rate supervisor at Tropicana’s Lumiere Place Casino & Hotels in St. Louis, Missouri.  She is represented by McClelland Law Firm, P.C. and Stueve Siegel Hanson LLP.
