Settlement Reached with Corrections Corporation of America (CCA)

SSH represented Assistant Shift Supervisors in a wage and hour collective action against CCA, which operates approximately 65 detention facilities in 19 states across the country. The case is titled Demetria McFadden, individually and on behalf of a class of others similarly situated v. Corrections Corporation of America, Case No. 09-CV-2273, and was filed in the United States District Court for the District of Kansas.

The lawsuit alleged that CCA violated federal wage and hour laws by misclassifying its Assistant Shift Supervisors as exempt employees and consistently failing to accurately record all time worked. It further alleged that CCA wrongfully requires its Assistant Shift Supervisors to be present at work and perform work in excess of 40 hours in a work week and fails to pay any overtime compensation.

On June 6, 2012, the United States District Court for the District of Kansas granted approval of a settlement of these claims. We anticipate funds will be distributed to the class members who opted-in to the litigation in the fall.
