Lawsuit Filed Against Experian for Reporting Illegal Western Sky Loans

On February 16, 2016, attorneys from Stueve Siegel Hanson and Berger & Montague, P.C. filed a class action lawsuit in Orange County, California against Experian, one of the “big three” credit reporting agencies, for reporting illegal payday loan debts on consumers’ credit reports.

The lawsuit alleges that Experian violated the Fair Credit Reporting Act (FCRA) by reporting inaccurate loan information furnished from Western Sky, a notorious online lender, and its affiliated companies CashCall and Delbert Services. Even though these loans carry interest rates exceeding 140% and are void and unenforceable in numerous states, Experian continues to report the loan debts as valid and outstanding—thus harming the credit of thousands of consumers.

 In reporting this information, Experian has ignored widespread and highly publicized law enforcement actions taken against Western Sky and its affiliated companies by at least 26 state and federal agencies, including the Federal Trade Commission and Consumer Financial Protection Bureau.
